Autism and the Prison Experience

Simplifying the First Step Act

The final rule on First Step Act (FSA) was only published in January 2022 in the Federal Register, over three years after President Donald Trump signed the legislation into law. Dep’t of Just., Bureau of Prisons, FSA Time Credits, 87 Fed. Reg. 2705 (Jan. 19, 2022) (to be codified at 28 C.F.R. pts. 523, 541). Like other criminal laws passed by Congress and signed into law, such as the Second Chance Act, the Bureau of Prisons’ (BOP) interpretation of FSA was narrow, and it was not until the Federal Register final rule that the real intent of FSA was clarified.

Bureau Of Prisons PATTERN Score Reveals Lower Recidivism For Campers

The National Institute of Justice (NIJ) provided their annual review and revalidation of the Prisoner Assessment Tool Targeting Estimated Risk and Needs (PATTERN). PATTERN is used by the Federal Bureau of Prisons (BOP) to measure general recidivism, chances of a person returning to prison again, and propensity for violence after leaving prison. Whereas many overall statistics tell a story that once someone goes to prison that they will likely return, the PATTERN score is proving to be an accurate measurement of a person’s chance of staying on the right side of the law after serving a prison term. However, the stats also tell a story of where prison programming should be focused.

Bureau Of Prisons First Step Act Calculator Not Fully Implemented

Federal Bureau of Prisons (BOP) Director Colette Peters has so many challenges facing the agency she leads that even glimmers of good news are touted as major successes. The BOP is suffering from a shortage of 6,500 staff (more than half of that for medical related openings), poor morale, and crumbling infrastructure. So when progress was made on a projected calculator to predict when prisoners would leave prison based on earning First Step Act credits to reduce their sentence by up to a year, it was a center piece to her testimony on Capitol Hill last month. The problem is, the calculator to project when prisoners will leave is simply not being used across the BOP.

The High Price Of Minimum Security Federal Prisoners

There are four security levels in the Federal Bureau of Prisons (BOP); minimum, low, medium and high. High security prisons are identified as U.S. Penitentiaries that house some of the most dangerous criminals, many doing life sentences. The compounds housing these prisoners which make up over 18,000 (11.8%) of the prison population have double fenced razor wire, electrical charged fencing, perimeter patrols and secure cells. In short, they are expensive to operate.

Inspector General Issues Report On Inmate Financial Responsibility

Former singer and now convicted sex offender R. Kelly had tens of thousands of dollars in his federal Bureau of Prisons (BOP) commissary account when a federal court stepped in and ordered the money seized to repay court costs and victims. The same happened for Larry Nassar, the disgraced doctor who assaulted young women athletes under his care. Both men are serving the equivalent of life in prison but the money in their commissary account was going to buy them some creature comforts to make their time in prison a bit better. Judge Cites Horrid Conditions At MDC Brooklyn At Sentence Hearing

The federal Bureau of Prisons (BOP) has huge challenges in front of it with crumbling infrastructure, staffing shortages and a troubled implementation of the First Step Act. While progress has been made, the BOP’s own troubles are now influencing the decisions of judges at sentencing. In one case in the Eastern District of New York, U.S. District Judge Gary R. Brown (Case No.: 23-CR-417) ordered that defendant Gary Colucci be sentenced to 9 month in prison. However, his order came with the stipulation, “... if the BOP opts to designate MDC [Brooklyn] as the relevant facility, then the imposed term of imprisonment will be vacated and, in its place, the defendant shall serve nine months of home incarceration ...”

Congress Set To Have New Oversight Over The Federal Bureau Of Prisons

There is little that unites both parties on Capitol Hill with the exception of overwhelming criticism of the Federal Bureau of Prisons (BOP). U.S. Senator Jon Ossoff’s bipartisan bill to strengthen BOP oversight passed the U.S. Senate and now heads to the President’s desk to become law. The bill comes on the heels of stories of staff corruption, inmate mistreatment, closing of prisons, and delays in fully implementing the First Step Act. Senator Ossoff has been a champion of BOP reform, holding hearings on the “rape club” at FCI Dublin women’s prison which has since been closed, and rampant corruption at USP Atlanta (now a Low security FCI Atlanta).

In speaking with men and women who have gone to prison, they experience withdrawals from having a cell phone once they are inside, something not allowed in federal prison. They feel imaginary vibrations in their pockets from a cell phone that is not there. They miss the connection with their family and friends. They are disconnected further from society. Loved ones who they used to text or call regularly have seemed to have vanished. The instantaneous access to calls, emails and information are over. It understandably takes a while to get used to. However, access to cell phones, particularly in minimum and low security prisoners is easy.

When can an eligible prisoner begin to earn First Step Act (FSA) credits?It seems like a simple question and the federal Bureau of Prisons (BOP) has determined that the prisoner can begin earning credits once they are at their designated facility. For those prisoners who self surrender to prison, many are low and minimum security prisoners, the credits start on the day the person arrived at prison. However, for some prisoners, they are remanded at the time of sentencing and then transported to their designated facility, a process that can take months as prisoners make their way through holdovers and county jails until they reach their final designation. Them arriving at their final designated institution is completely out of their control.

President Donald Trump became the first U.S. President to be convicted of a felony. He is also the first presumptive nominee of a major party to face a prison sentence just days before he is likely to be win the Republican Party’s nomination for president. If a prison sentence is imposed, there is a possibility Mr. Trump could end up in the same prison as a former head of state held in a federal Bureau of Prisons (BOP) institution decades ago.

Bureau Of Prisons Stumbles On Reducing Costs On Incarceration

In December 2018, the United States Congress overwhelmingly adopted the First Step Act, which then-President Donald Trump signed into law. The law provided a way to allow inmates to earn credits toward reducing their sentence by up to a year by participating in programming and productive activities. With ‘Eternal Gratitude’ Bureau Of Prisons Honors Fallen

May 7, 2024 started as a gray day at Washington D.C.’s National Law Enforcement Officers Memorial park where the federal Bureau of Prisons (BOP) honored 26 fellow corrections officers and contractors who have lost their lives in the line of duty. The two most recent casualties were those of Eric J. Williams and Osvaldo Albarati who were killed on consecutive days at two different institutions in February 2013. Williams died while working at USP Canaan where he was attacked and killed by an inmate and Albarati was ambushed and killed while he was driving home from work. After an investigation it was determined that Albarati’s shooting was carried out with assistance from federal inmates housed at MDC Guaynabo who relayed information by cell phones to assailants outside the prison.

Congress Issues Subpoenas On Inmate Tied To Hunter Biden

Two members of Congress Jim Jordan (R-OH), chair of the House Judiciary Committee, and James Comer (R-KY) chair of the House Oversight Committee, issued letters to U.S. Attorney Damian Williams of the Southern District of New York and BOP Director Colette Peters seeking information on whether or not there was interference with Galanis’ ability to get home confinement. The interference, the member of Congree believe, relates to information Galanis has on his former business partner Hunter Biden. Those letters received no response and now subpoenas for additional documentation were sent Friday to both the BOP and Southern District of New York.

The Federal Bureau of Prisons (BOP) did not renew its contract the the American Correctional Association (ACA). ACA specializes in providing accreditation services for correctional facilities at various levels, including state, local, federal, and private institutions.

Bureau Of Prisons Releases Encouraging Study On CARES Act

Congress passed the Coronavirus Aid, Relief, and Economic Security Act (CARES Act) on March 25, 2020 just as the pandemic reached the United States. CARES Act allowed individuals in federal correctional facilities who were a Low or Minimum security risk with underlying health conditions to serve their sentence in home confinement earlier than they would have been eligible for without the CARES Act.

CARES Act Prisoners On Home Confinement Become Political Pawns

The CARES Act, enacted in March 2020, included a provision allowing the transfer of nonviolent federal prisoners to home confinement due to COVID-19. Over 13,000 inmates benefited, but 2,600 remain on home confinement. Congress, through a proposed resolution, aims to return these inmates to prison.
